Typically people seek credit counseling when they are unable to manage the credit they have taken from credit card companies. There are several non-profit organizations in the business of credit counseling. Their primary objective is to help consumers get out of debt and regain their financial stability.

Typically the first session is free and the counselors create a plan that assesses the financial situation of the client, develops a reasonable spending plan, sets financial goals and then helps put these into action. Counselors can advise people that simply cannot get out of debt with their current income and therefore must declare bankruptcy. Sometimes, they will know of options that the average person in debt does not, and use it to their advantage.

Most of the counseling is done over the phone but the client is required to fill out worksheets and provide tax returns so that the counselor can get a clear picture of their financial resources. However, making such a plan requires skills that many consumers do not have and therefore counselors are can be an extraordinary amount of help when creating a debt management plan.

In addition to providing planning assistance, many counseling services can help consumers consolidate their debt by leveraging their relationship with credit card companies and banks. When such negotiation takes place the counseling agency takes an active role in continued debt resolution with follow-up sessions and in some cases, becoming a payment intermediary.

It is mandatory under the legal guidelines, that an agency follows AICCCA (Association of Independent Consumer Credit Counseling Agencies) standards to make sure that the customer gets the best quality of service. The agencies are typically non-profit organization with licenses and certified counselors working for them.

IRS Crushes Credit Counseling Groups Claiming Non-Profit Status

For the last five years, the IRS has been taking a much closer look at businesses claiming to be non-profit organizations. Given the reduction of tax loopholes over the years, the agency has taken note of the fact that many high-end tax strategies now involve some kind of charitable organization. In performing the analysis, the IRS has found no worse a collection of abusive businesses than the credit counseling industry.

Beginning in 2004, the IRS audited 63 credit counseling groups claiming non-profit status. These “charitable organizations” receive over fifty percent of all the revenues in the credit counseling industry, to wit, we are talking a major audit initiative. Well, guess what the IRS found?

To date, the IRS has completed 41 of the audits. Of these 41 audits, every single credit counseling business has had their non-profit status revoked, proposed for revocation or outright termination. Yes, every single entity has bitten the dust! Can anyone think of a bigger scam?

In crushing these bad apples, the IRS found a couple of amazing things. The primary reason for revocation was the groups provided insufficient public benefit. They offered little or no counseling or education to individuals. Instead, they were primarily motivated by profit according to the IRS. To top things off, the IRS found most of the businesses had “unique” dealings with for profit companies that just happened to be owned by the same interested parties. Imagine that! Shocking, I tell you.

It must be admitted that these rotten apples only represent roughly forty to fifty percent of the credit counseling industry. The rest of the industry that has not been audited might be entirely legitimate. The IRS does not seem to think so. In fact, it has sent out audit notices to every single company that has not yet been audited. I suspect the blood bath is just going to get worse.

In truth, not all credit counseling agencies are dubiously claiming non-profit status. The IRS, in fact, has noted it approved a whopping three applications for non-profit status out of 100 since 2003! Unfortunately, the IRS hasn’t indicated the identity of the three.

Credit counseling agencies are still fraught with corruption

The recently passed Bankruptcy Abuse and Consumer Protection Act requires, as a condition of filing for bankruptcy, that all debtors first meet with an approved credit counseling agency. This is designed to ensure that all debtors receive some sound advice regarding money management so that they can avoid having to file for bankruptcy again in the future.

The more you know about anything, the better you will be able to deal with any problems that may arise, and it’s no different with personal debt. The US Trustees office approves the agencies, and one would think that by doing so they have eliminated all of the disreputable credit counseling agencies from the mix.

It may not be so, and consumers with problem debt may still be at risk.

The Salt Lake Tribune recently reported that one agency that has been approved by the US Trustees to do business in Utah does not currently meet Utah state requirements for doing business in that state. Utah has moderately strict requirements for such businesses, including posting $100,000 bond and a simple filing to register to do business in the state.

How odd the Federal government would approve an agency that hadn’t even bothered to file a simple form to do business in the state! Another agency that was recently approved by the Trustees is now under investigation by Utah officials after numerous complaints from consumers that the agency in question took their money but failed to actually submit any of it to creditors.

As we have pointed out before, the credit counseling industry is one that is full of fraud. People go to these agencies in desperation, seeking a way to avoid losing everything they have. The agencies, in turn, see an opportunity to obtain fees from the consumers as well as a settlement from the creditors, who share a portion of collected funds with the agencies.

It’s a rare business opportunity to “double dip” and get money from both sides. In that regard, these agencies are not much different from bookies, who get money from both winners and losers on a bet.

The problem is that many such agencies aren’t content with that arrangement and would rather just keep most or all of the money paid to them by their clients. This gets them in hot water with regulators and puts their customers in even deeper trouble with the creditors to whom they owe money.

It would appear that the government isn’t being all that thorough with their screening process for “approved” agencies, so it’s still very much a “buyer beware” situation for consumers. Your best bet remains to talk to those who have already met with any agency you are considering.

Find former customers and talk to them. Find out if they have had a good experience and take that into consideration before handing over you money to an agency with which you aren’t familiar.

Credit Counseling Scams

Some of the worst scams involve offers to help consumers fix their credit. Our nation is so entrenched in the use of credit, it is inevitable that many will get behind on their payments. This common malady affects at least one person you know if not you, personally.

Credit card companies, banks, stockbrokers, stores, and other financial institutions make it sound so easy, who could resist. No interest! No payments until July! No annual fee! Just fill in this form and you can buy all the things you really can?t afford!

We are sucked into this system easily, but getting out of debt can be extremely difficult and stressful. The promises of all these credit providers become insults and threats as soon as you cannot pay for all the things they promised you could have when you filled out that form.

Many people do not know how to get caught up. Their situation may have changed since they applied for the credit and ran the bill up. They may have lost a job, had a baby, had an illness in the family, or had some other disaster strike which meant they could not make payments they had once agreed to.

The credit providers don?t offer much help. They offered you the credit. Now they want their money. They didn?t worry about whether they were giving you more credit than you could really afford. It?s not their problem. It?s your problem.

Then, here you are. You owe them money. The collectors are calling and sending you notices threatening to take your house, your car, or ruin your credit rating. They tell you that if you do not pay there will be dire consequences.

Then you see the ad or find the website that says, ?Credit Counseling. Let us help you get out of debt and get those bill collectors off your back for you.? You?re saved! Look, it?s even a not for profit organization. They are just there to help me. Where do I sign?

That?s where the trouble begins. Many companies have gotten into this lucrative venture and prey on people who are stressed out and have nowhere to turn. The credit card companies who recruited them so vigorously before have now abandoned them. The government isn?t offering to help. The IRS still wants their taxes. And now the knight in shining armor, the credit counseling service comes to the rescue.

The ad may say ?Consolidate your bills into one low monthly payment?, ?No Borrowing?, ?Use federal law to keep your property from being foreclosed by creditors?, ?Wipe out your debts?, ?Stop Garnishments?, ?Stop Collectors from harassing you?, ?Keep your property from being repossessed?, or other equally great sounding phrases that looks just exactly like what you need.

But, don?t get sucked in a second time. If you think the credit card companies sucked you into debt, you haven?t seen anything yet compared to what a disreputable credit counseling company can do to you.

Some of these companies offer to help you eliminate your debt altogether. If you get an email like that, delete it. If you find a website that says that, hit the back button and go somewhere else. Do not walk, run!

Sometimes, the best answer is to negotiate directly with the creditor. Be firm. Tell them what you can actually afford to pay. Do not promise more than you can deliver. They really have to take what you can actually pay if they want you to pay them off eventually. Avoiding them doesn?t work.

Many of these scams do not tell you what they actually charge and their fees can be worse than what you already owe. These companies will try to avoid giving you straight answers to your questions about their fees and have hidden costs they may not disclose at all. They know you turned to them because you are afraid your credit is about to be ruined and that they can pressure you into paying them later.

They also don?t tell you they are receiving a portion of whatever payments you are making to your creditors through them. That?s one of the ways they hide what they make from you.

Some of them will take the payments from you, then not pay your creditors with it on time, or in some cases not pay your creditors at all.

Never pay a credit counseling service an up-front fee to fix your credit or give you counseling or anything else. Many of these companies are only in place to make money from collecting that fee and never provide you with any credit counseling or other services at all. They?ve made their money and gone on to the next victim.

Many credit counseling scams are under investigation by the Federal Trade Commission and those claiming to be nonprofit are being investigated by the Internal Revenue Service and their nonprofit status is in danger of being revoked.

However, our government agencies will not save you. These unscrupulous credit counseling services will change their business names and be right back in business bilking consumers in no time at all as long as there is a buck to be made. Only your common sense can keep you from being ripped off by credit counseling scams.

Check them out with the Better Business Bureau. Search their company name online to find others who have used their service. Do not believe testimonials that appear on their own website or ones they send you in an email. They can just make those up.

If they have a website, go to http://www.betterwhois.com and type in the domain name to find out who the Registrant of the domain name is. Then search for their name on the web. Search their phone number or address on the web. Find out all you can about them before you sign up for anything. Ask a lot of questions.

Keeping up with the Jones seems to be the national past time these days. Unfortunately, the Jones are probably in some pretty heavy debt and all that glitters really isnt really gold, but in fact a gold Visa card! Credit is easier to get than ever, even for those of you who have already gotten in over your head. On any given day, most people will find applications from credit card companiesright along with the late notices from others.

If you find that youve fallen victim, and are in over your head, there is help. Credit counseling is one way to attack your debt problem head on!

Look online or in your local phone book to find a good, reputable credit counseling service. One word of warningdont answer an ad or call anyone who claims that they can repair your credit, or give you a new credit identity. Its a sure thing that they are running a scam, and you will simply waste time and more of your money.

Reputable credit counseling services have some criteria you must fulfill, and although it varies from organization to organization, the basics are that you must have a source of income and a specific amount of unsecured debt. (They wont be able to help you with secured debt, such as automobile loans and home mortgages.) Once you have chosen an organization and made an appointment, you should be prepared to take in all copies and statements from your current loans. They will need to see the balances that you owe, and in addition, what monthly payments are expected from you.

Youll find very knowledgeable people who will sort out your bills and consolidate them into one payment every month. You will have the option of making your payment directly to the credit counseling service, and then they will make sure that it gets to your creditors every monthon time. Credit counseling is really quite amazing in that the counselors have an uncanny power of negotiation with creditors and many times are able to reduce (or eliminate) interest rates, waive late and over-the-limit fees, and work out better repayment terms. This will help you pay off your debt much faster than you could on your own.

But the credit counselors dont stop there! Once they have managed to get your debts contained and into a monthly payment that you can afford, they will begin to work on your budget and spending habits in order to improve you financial health even more. They will prepare a personalized budget for you, and then show you how to spend without getting into trouble, and even how to save. Some offer software packages that you can use at home to implement your new budget. In addition, they will be available for questions and can help you sort things out if something unexpected comes up.

One thing that you should know; if you decide to use credit counseling services, is that you will be required to cut up your cards as part of the package! In fact, a few credit counseling services have been known to make little collages out of all of the pieces and hang them on the wall. But the good news is that getting your debt paid off will help to rebuild your credit, and after its all paid off (and youve developed good spending habits), you can talk to your counselor about trying again. But until then, break out the scissors!
